Notice of Amendment(s) to the Braintree Agreement(s)

This page details and/or previews updates to Braintree users of changes to the Braintree Payment Services Agreement or other online agreements, policies, or statements that require notice. You can also review Past Policy Updates notices. Note that additional changes could be made to previewed agreements on or before the effective dates listed, provided the applicable notice requirements are met.

Upcoming Changes

We’re making changes to certain agreements (listed below) that govern your relationship with PayPal. These changes will take place automatically on the corresponding effective date(s) shown below.

Actions Needed

Please carefully review the notices below and familiarize yourself with the upcoming changes. By continuing to use our services after the changes take effect, you agree to be bound by those changes. Otherwise, no further action is needed from you to accept such changes. However, if you would prefer to decline them, then you will need to close your Braintree account prior to the applicable effective date, as described in the Payment Services Agreement.

Updates to the Braintree Payment Services Agreement

Effective Date: 28 May 2026

For existing EU Merchants, the changes below will be effective from 28 May 2026. For all new EU Merchants, the changes will apply immediately from 28 May 2026.

  • We are updating our agreement to include additional terms applicable to the use of vaulting functionality, including when using services such as network tokenisation and account updater.

Updates to the Braintree Payment Services Agreement

Effective Date: 29 June 2026

  • We are introducing new optional services, Chargeback Protection Tools, by adding a new Section 7 to the Braintree Payment Services Agreement (with existing sections renumbered accordingly). This update does not apply to merchants in Austria, Cyprus, Denmark, Ireland, Liechtenstein, and Poland.
  • The Chargeback Protection Tools are optional services under which PayPal will assess eligible Braintree credit and debit card transactions for fraud risk and, for qualifying transactions and eligible chargebacks (limited to fraud and item-not-received claims), allow you to retain the chargeback transaction amount and waive applicable chargeback fees.
  • The updated Agreement sets out the applicable eligibility requirements, excluded transactions, proof of shipment or delivery requirements, applicable fees, a monthly loss cap of 1.80% of Monthly Eligible Transaction Volume and the circumstances in which PayPal may recover previously waived amounts or suspend or cancel the service.
  • The Chargeback Protection Tools are available in two options: Chargeback Protection at 0.59% per Eligible Transaction and Effortless Chargeback Protection at 0.80% per Eligible Transaction. From the effective date, fees will also be set out on the Braintree Fees Page for your market.
  • This is an optional service and no action is required unless you choose to enrol. If you do not agree to these changes, you should not enrol in or use the Chargeback Protection Tools. You may also close your Braintree account in accordance with your Agreement.

Updates to the First Data Commercial Entity Agreement

Effective Date: 13 May 2026

We have updated the First Data Commercial Entity Agreement (CEA) for EU merchants to reflect a change in our card network acquiring member. First Merchant Processing (Ireland) DAC has replaced First Data GmbH as the Member for EU card processing. No changes have been made to the commercial terms of the CEA.

Updates to the Braintree Payment Services Agreement
